{"id":20010,"date":"2016-05-12T20:48:20","date_gmt":"2016-05-12T19:48:20","guid":{"rendered":"http:\/\/www.patentattorneys.ch\/?p=20010"},"modified":"2016-09-08T12:36:39","modified_gmt":"2016-09-08T11:36:39","slug":"devoir-de-confidentialite-privilege-conseils-brevet-suisse","status":"publish","type":"post","link":"https:\/\/www.patentattorneys.ch\/en\/2016\/05\/12\/devoir-de-confidentialite-privilege-conseils-brevet-suisse\/","title":{"rendered":"Duty of confidentiality and privilege for Swiss patent counsellors"},"content":{"rendered":"<h6>The law on Patent counsellers (LCBr) has now been in force for almost five years.\u00a0 Amongst its new features, it provides for\u00a0a particularly strict duty of professional secrecy, which goes beyond the obligation to professional secrecy of ordinary business relationships.<\/h6>\n<p>Art. 10 LCBr ties the patent counsellor to professional secrecy for all secrets which are entrusted to him\u00a0due to his profession or in the exercise of the latter. In fact, counsellors often receive confidential information\u00a0about an\u00a0invention that has not yet been registered or business secrets. Clients have a preponderant interest that no third-party has knowledge of this information. For this reason the client must have total confidence in the patent counsellor in terms of\u00a0professionnel secrecy, and to be able to explain to\u00a0 him\u00a0all the important facts without having to sign a confidentiality agreement with him.<\/p>\n<p>The professional secrecy referred to in\u00a0art. 10 LCBr is legally guaranteed on two levels &#8211;\u00a0material and procedural. First of all, its violation by the patent counsellor or by its auxiliaries\u00a0is punishable under\u00a0art. 321 al. 1 of the Swiss\u00a0penal code.
